1. ABOUT THESE TERMS
These Terms of Service (“Terms”) govern your use of the True Orgonite website at trueorgonite.com and purchases made through it.

In these Terms, “True Orgonite”, “we”, “us” and “our” mean True Orgonite Ltd.
“You” and “your” mean the person using the website or purchasing products from us.
These Terms apply primarily to purchases made by consumers for personal use. Nothing in these Terms affects any statutory rights that cannot lawfully be excluded or restricted.
2. TRUE ORGONITE AND OUR CREATORS
True Orgonite operates an online platform specialising in handmade orgonite and related artistic creations produced by independent makers (“Creators”).
Although products may be designed, manufactured, packaged and/or dispatched directly by an independent Creator, True Orgonite Ltd is the contracting seller to the customer for products purchased through trueorgonite.com unless we expressly state otherwise before purchase.
Your purchase contract is therefore with True Orgonite Ltd, not with the individual Creator.
Creators act as independent suppliers and fulfilment partners in connection with orders placed through True Orgonite.
True Orgonite remains responsible to you for the consumer obligations that apply to us as seller.
3. AGE AND ELIGIBILITY
You must be at least 18 years old to place an order or create a customer account through True Orgonite.
By using the website, you confirm that:

You will not use the website for unlawful or fraudulent purposes.
4. HANDMADE PRODUCTS
Products sold through True Orgonite are individually created by independent makers.
Because products are handmade, reasonable variations may occur in:

Colour.

Resin patterns.
-
Crystal positioning.
-
Metal distribution.
-
Shape.
-
Finish.
-
Dimensions.
-
Weight.
-
Texture.
-
Other individual characteristics.
These natural variations are part of handmade production and will not normally constitute a defect provided that the product remains materially consistent with its description.
Product photographs are intended to represent products as accurately as reasonably possible. Colours and appearance may vary slightly depending on lighting, photography and the screen or device used to view the website.
Where a listing relates to the exact individual item pictured, we will endeavour to make this clear.
5. PRODUCT DESCRIPTIONS AND ORGONITE INFORMATION
We take reasonable care to ensure product information is accurate.
Listings may contain information including:

Creator.

Country of origin.
-
Materials.
-
Crystals.
-
Metals.
-
Resin.
-
Approximate dimensions.
-
Approximate weight.
-
Construction method.
-
Artistic or historical background.
Minor measurement and weight tolerances may occur because products are handmade.
True Orgonite may also publish historical, cultural, artistic, educational or creator-supplied information concerning orgonite, orgone theories, crystals or related subjects.
Such material is provided for informational, cultural, artistic or educational purposes.
True Orgonite does not represent that its products diagnose, treat, cure or prevent disease or provide medical, therapeutic, health, protective or scientifically guaranteed effects.
Products should not be used as a substitute for professional medical, psychological, electrical, engineering or safety advice.
No statement concerning beliefs, personal experiences, historical theories or creator practices should be interpreted as a medical or scientifically established claim unless expressly supported by appropriate evidence and clearly identified as such.
6. PLACING AN ORDER
Before submitting an order, you will have an opportunity to review the products selected, quantities, delivery information and price and to correct errors.
By submitting an order requiring payment, you are making an offer to purchase the relevant products from True Orgonite Ltd.
An automated email acknowledging receipt of your order does not necessarily mean that your order has been accepted.
Our acceptance occurs when we confirm that the order has been accepted for fulfilment or dispatch.
At that point a contract is formed between you and True Orgonite Ltd.
We may refuse or cancel an order before acceptance where reasonably necessary, including where:

A product is unavailable.

Payment cannot be authorised.
-
An obvious pricing or listing error has occurred.
-
We reasonably suspect fraud or unauthorised payment.

We cannot lawfully supply the product.

Delivery to the requested destination is unavailable.

Information necessary to fulfil the order has not been provided.
Where payment has already been taken for an order that we cannot accept, we will refund the amount paid.
7. PRICES
Prices displayed on the website are shown in the currency selected or displayed by the website.
The total amount payable will be shown during checkout before you submit your order.
Prices include taxes where those taxes are required to be included in the displayed price.
Where additional taxes, customs duties, import VAT or similar charges may lawfully become payable by the recipient because of international delivery, we will provide relevant information before purchase where reasonably practicable.
We may change prices at any time, but changes will not affect an order already accepted by us.
If we discover an obvious pricing error before accepting an order, we may contact you and allow you to purchase at the correct price or cancel the order.
We are not obliged to supply a product at a price that is clearly and unmistakably incorrect where the pricing error could reasonably have been recognised as an error.
8. PAYMENT
Payment must be made using one of the payment methods available at checkout.
Payment services may be provided by third-party payment processors.
We do not normally receive or store your full debit or credit card details.
Your payment may be subject to additional terms and security checks imposed by the relevant payment provider.
We reserve the right to delay fulfilment where a payment is pending verification or has not been successfully authorised.
9. DELIVERY AND CREATOR FULFILMENT
True Orgonite works with Creators located in different countries.
Products may therefore be dispatched from locations including the United Kingdom, Europe, the United States, Canada, South Africa or other countries identified on the relevant product listing.
The dispatch origin should be stated on the product page where relevant.
Because products may be dispatched directly by Creators, an order containing products from more than one Creator may arrive in separate packages and at different times.
Delivery estimates are estimates and not guaranteed delivery dates unless we expressly agree a specific delivery date with you.
Unless another delivery period has been agreed with you, goods will be delivered without undue delay and normally no later than 30 days after the contract is entered into.
Where a product is made to order and requires a longer production period, the expected production or delivery period will be stated before purchase and will form part of the contract.
Please contact hello@trueorgonite.com if your order has not arrived within the stated delivery period.
Your statutory rights relating to delayed or failed delivery are not affected.
10. DELIVERY ADDRESS
You are responsible for providing a complete and accurate delivery address.
Please contact us immediately if you identify an error.
We will make reasonable efforts to correct the address before dispatch, but we cannot guarantee that an address can be changed after fulfilment has begun.
Nothing in this section removes any responsibility we have where goods have not been properly delivered in accordance with the contract.
11. RISK IN GOODS
Goods remain at our risk until they come into your physical possession or the physical possession of a person identified by you to receive them.
The fact that an independent Creator or delivery company physically transports the product does not by itself transfer that risk to you before delivery.
12. INTERNATIONAL ORDERS, CUSTOMS AND IMPORT CHARGES
Some products are dispatched internationally.
Depending on:

The country from which a product is dispatched.

The delivery destination.

The value of the shipment.

Applicable tax and customs rules.
an international shipment may be subject to import VAT, customs duties, handling charges or similar governmental or carrier charges.
Where taxes or charges are collected by True Orgonite at checkout, they will form part of the amount payable.
Where lawful charges are not collected at checkout and are instead payable by the recipient on import, we will provide relevant information before purchase where reasonably practicable.
We do not control charges imposed independently by customs authorities or carriers.
Nothing in this section permits us to impose an undisclosed mandatory charge on you after a contract has been formed.
13. YOUR RIGHT TO CANCEL AN ONLINE ORDER
For most goods purchased online by UK consumers, you have a statutory right to change your mind.
Unless an exemption applies, you may cancel your purchase within 14 days after the day on which you receive the goods, without giving a reason.
Where one order is delivered in separate shipments, the cancellation period normally runs from receipt of the final item forming part of that order where applicable under consumer law.
To exercise your cancellation right, you must clearly tell us that you wish to cancel.

You may use the Model Cancellation Form at the end of these Terms, but you are not required to use it.
14. RETURNING GOODS AFTER CANCELLATION
After notifying us that you are cancelling under your statutory cancellation rights, you must normally return the goods within a further 14 days.
Return instructions will be provided when you contact us.
Because products may have been supplied by international Creators, we will tell you the appropriate return address for the particular order.
Do not return an item to a Creator or overseas address without first obtaining return instructions from True Orgonite.
You are normally responsible for the direct cost of returning goods where you simply change your mind.
We will pay or reimburse reasonable return costs where required by law, including where goods are faulty, damaged, incorrectly supplied or not as described.
15. CONDITION OF CANCELLED GOODS
You may inspect and handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning, in broadly the same way you could inspect goods in a physical shop.
You are responsible for any reduction in value caused by handling beyond what is reasonably necessary for that purpose.
Where permitted by law, we may reduce a cancellation refund to reflect that reduction in value.
This does not affect your rights where the goods are faulty or otherwise fail to conform to the contract.
16. REFUNDS FOLLOWING CANCELLATION
Where you validly cancel under your statutory cancellation rights, we will refund:

The price paid for the cancelled goods.

The cost of our least expensive standard delivery option, where applicable.
If you selected a more expensive delivery method than our standard delivery option, we are not required to refund the additional delivery cost unless the law requires otherwise.
We will normally issue the refund within 14 days after:

We receive the returned goods; or
-
You provide evidence that you have returned them,
whichever occurs first.
Refunds will normally be made using the original payment method unless otherwise agreed.
We will not charge a cancellation or restocking fee for exercising a statutory cancellation right.
17. PERSONALISED AND CUSTOM-MADE PRODUCTS
The statutory right to change your mind may not apply to goods that are:

Made to your specifications; or

Clearly personalised.
This exception only applies where the product genuinely falls within the applicable legal exemption.
A product is not automatically exempt simply because it is handmade or produced after an order is placed.
Where a product is personalised or made to a customer's specifications and the cancellation exemption applies, this will be made clear before the order is placed.
Your rights regarding faulty, damaged, unsafe, misdescribed or non-conforming personalised products remain unaffected.
18. FAULTY, DAMAGED OR MISDESCRIBED GOODS
Under the Consumer Rights Act 2015, goods supplied to consumers must be:

Of satisfactory quality.

Fit for any particular purpose made known to us where the legal requirements are met.

These rights apply independently of the cancellation rights for online purchases.
Where goods do not conform to the contract, UK consumers may have statutory remedies including:
Short-Term Right to Reject
In most cases, you have a 30-day short-term right to reject goods that do not conform to the contract and receive a refund.
Repair or Replacement
After the short-term right to reject has expired, or where you choose not to exercise it, you may be entitled to repair or replacement.
Because many True Orgonite products are unique handmade items, an identical replacement may not always be possible. Where that is the case, we will discuss an appropriate lawful remedy with you.
Price Reduction or Final Right to Reject
Where repair or replacement is unavailable, unsuccessful or cannot be provided within a reasonable time and without significant inconvenience, you may have a right to an appropriate price reduction or final rejection and refund in accordance with consumer law.
Nothing in our Refund Policy or these Terms limits these statutory rights.
19. GOODS DAMAGED IN TRANSIT
Please inspect your order after delivery.
If an item arrives damaged, please contact us as soon as reasonably possible at:

Photographs of the packaging.
Requesting photographs helps us investigate damage with the Creator or carrier and does not remove your statutory rights.
20. REFUND POLICY
Our separate Refund Policy provides additional practical information about returns and refunds.
The Refund Policy forms part of these Terms where applicable.
Nothing in the Refund Policy limits or replaces your statutory consumer rights.
If any voluntary provision of the Refund Policy conflicts with a mandatory right under applicable consumer law, the statutory right takes priority.
21. PRODUCT SAFETY AND CARE
Products should be used and handled reasonably and in accordance with any care or safety information supplied.
Some products may contain:

Metal.
-
Crystals.
-
Glass-like surfaces.
-
Small decorative components.
-
Sharp or pointed decorative features.
Products are not toys unless expressly described as such.
Keep unsuitable products away from young children and pets.
Do not ingest product components.
Damage caused by misuse, deliberate damage, improper storage or treatment inconsistent with supplied care instructions is not treated as an inherent product defect.
This section does not affect rights arising from a product that was unsafe, defective or non-conforming when supplied.
22. WEBSITE CONTENT
We aim to keep the website accurate and available.
However, we do not guarantee that:

The website will always be available without interruption.

Every error will be corrected immediately.

All content will remain available permanently.
We may update, remove or modify website content where reasonably necessary.
Changes made to website content after an order has been accepted will not retrospectively alter the agreed terms of that order.

is owned by or licensed to True Orgonite Ltd and is protected by applicable intellectual property law.
Creator photographs, designs, artworks and other Creator-owned content may remain the intellectual property of the relevant Creator and are used by True Orgonite with permission or under the applicable Creator agreement.
You may access website content for personal, non-commercial purposes.
You may not reproduce, republish, commercially exploit, distribute or modify protected content without permission from the relevant rights holder, except where permitted by law.
24. CUSTOMER REVIEWS AND CONTENT
Where we allow customers to submit reviews, images, comments or other content, you must not knowingly submit content that:

Is unlawful.

Is fraudulent or misleading.

Infringes another person's intellectual property rights.

Contains malicious software.

Contains unlawful threats, harassment or defamatory material.

Misrepresents your experience with a product.
You retain ownership of content you create.
By submitting content for publication, you grant True Orgonite a non-exclusive, worldwide, royalty-free licence to display, reproduce and use that content for operating and promoting True Orgonite and the relevant products, subject to applicable law and our Privacy Policy.
We may moderate or remove content where we reasonably believe it breaches these Terms or applicable law.
25. THIRD-PARTY LINKS
The website may contain links to websites or services operated by third parties.
Those websites are independently controlled and may have their own terms and privacy policies.
True Orgonite is not responsible for the content or operation of an independent third-party website merely because our website links to it.
26. SHOPIFY AND OTHER SERVICE PROVIDERS
The True Orgonite website uses Shopify and may use additional third-party services to provide ecommerce, payment, marketplace, delivery, analytics and website functionality.
These third parties provide technology and services to True Orgonite but do not replace True Orgonite Ltd as your contracting seller where these Terms state that True Orgonite is the seller.
Third-party providers may process personal information as described in our Privacy Policy.
27. PRIVACY
We process personal information in accordance with our Privacy Policy.
Our Privacy Policy explains:

28. OUR LIABILITY TO CONSUMERS
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, we do not exclude or limit liability for:

Any other liability that cannot lawfully be excluded or limited.
If we breach these Terms, we are responsible for losses that are a foreseeable consequence of that breach or our failure to exercise reasonable care and skill.
A loss is foreseeable where it was obvious that it would happen or where, when the contract was formed, both you and we knew that it might happen.
We are not responsible for business losses suffered by a consumer where the product was purchased wholly for private use, including loss of profit, business opportunity or commercial revenue that was not within the reasonable contemplation of the consumer contract.
Nothing in this section restricts any remedy you have under mandatory consumer law.
29. EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delay caused by circumstances genuinely outside our reasonable control where the law permits.
Examples may include:

Significant transport disruption.

War or civil disturbance.

Major telecommunications or infrastructure failures.

Government restrictions.
Where such an event materially affects an order, we will take reasonable steps to minimise the delay and communicate with you.
This section does not remove rights you may have to cancel an order or receive a refund where goods are not delivered within an agreed or legally required time.
30. SUSPENSION OR TERMINATION OF WEBSITE ACCESS
We may suspend or restrict access to an account where reasonably necessary, including where we reasonably believe there has been:

32. IF PART OF THESE TERMS IS INVALID
Each section of these Terms operates separately.
If a court or competent authority determines that a provision is unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
33. DELAY IN ENFORCING THESE TERMS
If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.
34. TRANSFER OF RIGHTS
We may transfer our rights or obligations under these Terms to another organisation where permitted by law and where doing so does not reduce your consumer rights.
We will notify you where a transfer materially affects your rights.
You may only transfer your rights under a contract where the law permits or where we agree.

We want to resolve problems fairly and promptly.

We will review the complaint and work with the relevant Creator, fulfilment provider or carrier where necessary.
Your statutory rights remain unaffected by our complaints procedure.
36. GOVERNING LAW
These Terms and contracts entered into through True Orgonite are governed by Scots law.
If you are a consumer living elsewhere in the United Kingdom or another country, this does not deprive you of mandatory consumer protections that apply to you under applicable law.
37. JURISDICTION
Subject to mandatory consumer rights, the Scottish courts have jurisdiction in relation to disputes concerning these Terms or purchases from True Orgonite.
Nothing in these Terms removes any right a consumer has under applicable law to bring or defend proceedings in another court that has jurisdiction, including a court in the part of the United Kingdom in which the consumer lives where applicable.
